How do i use the grounds constructive abandonment in a divorce proceeding?

This is a ground I can use in New York State...Someone Please Help!!

1. You need to determine how those grounds apply to your marriage. My ex filed for divorce on those grounds...in our case it meant I refused to sleep with him..well, duh, he walked out on me and wanted a divorce so was I gonna 'service ' him? lol...so I could have fought it but why? It would not affect the division of property or child support/visitation issues so my lawyer said let him file....it'll cost him more for the divorce since he was the one to file...so I didn't contest it...good luck.
