How do I go about getting a legal separation?

I live in Southern Indiana and need to know how I go about getting a legal separation. Do I need a lawyer? Does it cost much to file the papers? I assume my husband and I have to go together to file for this? I was thinking of going to the county clerk's office Monday morning or afternoon, is that where I start if I don't need a lawyer? I can't find the answers I need online. Thanks for any help.

  2. You do not need a lawyer to file papers and you dont have to go with your husband either, you can go alone and it costs 250.00 to file the papers but you can get it done for free if you qualify for it. Good luck and sorry.
  3. A separation is a divorce without permission to remarry. Why would you pay to separate if it costs the same as getting a divorce? If you are going to divide everything up...and agree on everything, it would be easier to file for divorce. Sit down and separate the belongings and file a joint petition for divorce. Just my opinion.... UNLESS you are going to work on the marriage, and in that case I would ask him to go to counseling instead of filing with the courts. Either way...Best wishes
  4. each State have different laws set up for those type things so your best thing to do is contact a lawyer. The county clerks office can explain what you need to do too.
  5. County clerks office is a good place to start. However many states no longer honor separations. It's either divorce or separate on your own.
