Is kissing legal grounds for divorce? If a married woman kisses another man can her husband get everything in a divorce. If its say a peck on the lips. Is there a lawyer out there or someone that knows how the court views it?
My husband is an in-the-closet. My marriage was a sham! What are the legal grounds for divorce in California? I was married almost 20 years. Gradually over time I realized that my husband was NOT RIGHT. When my youngest was less than two years old, I realized that he was a cross-dresser. I talked with his mom, she assured me it was something he "always did" and was harmless. (needless to say it totally freaked me out). Over time I realized that he actually was in homosexual "hookups" with other TG's he met online. I was so embarassed, I knew I needed to talk with someone, but who? Anyway, fast forward... my kids are almost grown. I left two years ago, but he wants to fight tooth and nail through the divorce...can this information help me? Or will it just make things ugly without helping my case?

Is not bathing grounds for a divorce? Does my cousin have grounds for divorce ? New York Uncontested divorce? My wife and I are in the process of filing for an uncontested divorce in NY state. I understand the legal grounds for divorce. Neither of us has committed any real fault but I am still willing to agree to the fault as the defendant and sign all the paperwork. Is there anything that the NY court system would require to have proof of fault to authorize the divorce? He has accused me several times of cheating, and says that he will bring it up in the divorce; since he has no proof(cause I haven't), since we have no kids together or property to divide (only married 3 months), should I hire a lawyer anyway since he's making threats but has no grounds or proof of them and since there's nothing to take away from me, such as kids, house, car (it was all mine before we were married)? Legal aid through divorce? Please help! Horrible situation :(? My best friend is currently undergoing divorce proceedings, and his decree nisi was announced on 24th Sept 2009, which means the earliest he can apply for a decree absolute is on the 6th November. So far he has been representing himself, as he really can not afford a solicitor. He is the petitioner and instigated the divorce proceedings under the grounds of unreasonable behaviour. (he was married in jan 2005, and his wife basically treated him like a dog and abused his finances until he ran up a huge debt, and when he ran out of money she consequently left him in may 2008. He filed for divorce in June 09) Yesterday he got a letter from her solicitor claiming that he had caused her stress because he was not compassionate when her brother died and wants £14,000. He wasn't even aware of her brother dying and would have certainly tried to contact her family if he had known. He is now earning less than £14,000 a year, his current account is over £3000 overdrawn, he has a loan of £10,000 to pay off and his credit card debts all mount to another £10,000. He has copies of all of his transactions, most of the debt went into running the matrimonial home, and financing her lifestyle to keep her happy. He is currently homeless as he got evicted from his rented property and is living with a family friend. How does he reply to such a demand of £14,000,he can't afford a solicitor and he really doesn't know what to do. How do we write a strong letter back to say she's a total bitch and he has no money to giver her because SHE'S run up his debt? How do we get legal aid? Please help :(
Is it allowed for my wife's solicitors not to pass on a letter intended for my wife? My friend's and family suspect my wife of having an affair however I do not like to believe this is so... but that's another story. Basically my wife has no legal grounds for divorce as I have done nothing wrong and is attempting to get an injunction on me for grounds of harassment and molestation for a reason to divorce me - I deny these allegations and live approx. 200 miles away. I wrote one letter to my wife via her solicitor that was passed on however now they are refusing to send another letter, of five pages, claiming this to be harassment. Are they allowed to do this? I doubt my wife was sent a copy as they have told me they haven't and I sent the letter by e-mail at 7pm in the evening only to get a reply at 9am via e-mail the next morning informing me of their refusal. Furthermore, her solicitors told me that it says divorce on file when she cannot get a divorce yet due to us not being married a year. Surely, this is bad and unprofessional conduct. I have a solicitor and she has advised me that for divorce to be initiated a period of a year needs to have gone by. Furthermore, I still love my wife and for this and religious reasons it is killing me. In Ohio, what legal rights does a husband have to a home, if lived apart for 2 yrs? Is anyone a lawyer or specifically know the legal rights here. I'm helping a friend who is trying to find a lawyer right now. Her husband moved out of state for work 2 yrs ago. She has seen him on & off out there and they still put their money together, etc.. but he has not set foot in the house in 2 yrs. They have been unable to work out problems and are considering divorce. I know typically in Ohio both parties have equal rights to house during course of divorce. He is verbally and possibly physically abusive but nothing to the point she legally can get restraining order. She feels he will move back in just to terrorize her if she files for divorce. On what grounds should she get divorce? My friend separated from her husband about a year ago because she suspected that he was cheating on her. Divorce i England...? If a person in England wants a divorce and is going to ask for legal aid for the grounds of divorce as adultery how long does it take to get the legal aid/do the divorce? The wife wants him to admit to adultery so wants to file herself now since he can't file that against himself under unreasonable behavior. Even though he said he'd add a paragraph admitting when she kicked him out asking him to not return and he went to stay with a female freind and that that could be considered adultery...so to please her with the adultery statement. husband and I are separated-served divorce papers-no legal aid, no lawyer. will i lose my kid? My husband and i have been separated for 2 years. judge appointed me parental rights (husband gets son every other weekend and for up to 21 days at a time in the summer). when i called to arrange for pick-up, husband handed me divorce papers and refused to return the child (he also got a restraining order against me). I qualified for legal aid yesterday, but they called me today to tell me that they cannot help me (I do not know why) and that i should get a lawyer. I cannot afford one. Our court date is this Friday. What should i do? Can he win custody simply because he can afford a lawyer and I cannot? Husband has made many claims, but i was told that there is no grounds for it and that the only thing that he has on me is more money. Any advice. I am desperate and time is running out. Need serious (quick) help, legal question, self representation, divorce and child custody? This is a long question, but please take the time to read it. I'll start from the beginning, I have been married for a few years, the relationship started getting very rocky as soon as he moved me away from my family and surrounded me with his, this is when I think he felt like he had me trapped, I was married to him, pregnant with his child and away from anyone I knew. He began to be very controlling. We have a little girl now, who is the light of my life, and whom I love more than words can possibly express. Recently some of my family came to live with us, and even though he didn't like it, he's scared of everyone except me and never had the balls to tell them to leave. I have been a stay-at-home mom since my daughter was born, that was a decision we both made. I, however, wanted to go to school, my husband didn't like this idea. When my family was here though, I was less scared and enrolled myself in GED classes and made plans to attend college. I'd asked my husband for a divorce before, and he'd made it very clear that he didn't want one and he would contest it. I didn't have enough money for a lawyer for a contested divorce, so my plan was to stick it out until I graduated in a couple years and then leave him. I never had access to the bank account or any of the money other than the cash he would reluctantly give me for groceries. He became very uncomfortable when it became clear that I was serious about getting my education and also because I now had someone around to stand up for me other than myself. We got in a huge fight and again I asked for a divorce, he again said no, but started to drain our bank account of the few thousand dollars we had in there, behind my back and unbeknownst to me. He hired a lawyer, had some papers drawn up, including divorce papers, but also a restraining order against me, preventing me from having custody of my daughter (on the grounds that I would somehow drive 400 miles to the rest of my family, with the car that he knew had no gas, but then not have enough money to provide her with basic necessities once I arrived), all of this behind my back. I was served these papers on the 30th of last month, they took my daughter away, and I have been frantically trying to find legal help ever since. On the restraining order, it said that I have a hearing on Monday the 13th and that this is going to be held in a town I've never heard of, about an hour an a half away, apparently there is only one chancellery judge in the area and he serves 7 counties, I guess this was his soonest available date. I have talked to every lawyer in town (which is only 3) but all need at least a grand to do anything for me. One promised to let me make payments, but after waiting a week for an appointment and selling things to get the $150 consultation fee, told me that he would need almost 2 grand up front. I tried everything I could think of to get the money, called everyone I knew, but no luck. There is one legal aid service in this area, I've been calling and leaving messages for them almost everyday since she was taken away but so far they have no returned one call. I went to their office and was just given an extension number to try on the number I'd already been calling, left a new message for this person, still no return calls, I guess they are very busy. I've tried to obtain a court advocate, but the people in my county won't drive that far, and I can't get a hold of anyone in the county the hearing is being held in until Monday, which is obviously too late. So, it looks like I'm going to be walking in there alone, representing myself. I have two family witnesses that have seen him be violent towards me, they've also seen him be extremely neglectful of my child. I have pictures of my daughter's living conditions now (she is staying with my husband and his mother), which are deplorable and dangerous. I've called DCS, but I've been told they will not investigate since there we are involved in this court thing and there is really nothing I can do about it. I may be still able to obtain a picture of a bruise that he left on me, he deleted it from my phone, but I've been told with the right software it may be recoverable (I'm waiting on a cell phone data cable I ordered to arrive, hopefully sometime today). My case is very good, the problem is, he has a lawyer and I don't. I don't know what kind of lies they are going to make up, and I have no one to question him and trip him up in his lies. I don't know the legal procedures for submitting evidence, or asking questions, or anything really. I have no court experience. Even if you don't have much law knowledge, if you've been through anything like this and can tell me what it's like and what to expect, I would really appreciate it. If you do have some law knowledge, that's even better because I desperately need it. Trust me if I even had anything to sell for money for a lawyer, I would gladly do it but I have NOTHING, he has made very sure of this. I'm trying to get a job now (had an interview today), but until then I literally have about 3 cents. Please stop telling me to get a lawyer, I would love one, I would do anything to get one. I have tried everything humanly possible to get one, but my husband has done everything in his power to ensure that I can't get one. I have no choice but to represent myself, I need to know what to do when I get in court.
What are grounds for annulment in Australia? I am American and my wife is Japanese. Although we were in a true relationship, we entered into a legal marriage in Japan for residential reasons (i.e., to get her a visa). Now we are separated and I want to marry someone else (for real this time). Green card and divorce ? Hello Folks I am at the stage of applying for Adjustment of Status ( 485 / 765 etc). My 140 was approved long ago on the basis of extra ordinary (research) talent. Now my situation is that I have to get divorce from my wife ( who BTW used me as an immigration door ) & who's presently abroad. If My Green Card comes soon & I decide to remarry AFTER my GC comes, how difficult or simple is the procedure for me to get my future spouse. I heard there is some new V1/v2 Category. - Is it simple enough for her to come that way in the sense that It would faced w/ a cap etc. - If my parents want to visit ( not stay for good ) me & I have a GC how do they come ? - Finally if my future spouse were to have a V1 visa & I need to get her a GC , is that poss. in US or that'd mean returning back to your homeland , waiting in line & returning back w/ a new set of paper work. - Last but not the least , suppose ( just on assumption) if my present wife comes to US on GC & I divorce her there,duly notify immigration that I am divorced & she can go back after divorce has occurred ,then can I use my earlier wife's paper work to get any future prospective one. Please note I am no moslem or polygamist.If there is any reason I prefer divorce in US its b cos I can at least expect some fairness & not gender biased/perverted laws(visit www.498a.org) for any potential divorce proceedings. What constitute cheating and infidelity in a marriage? And how does this impact divorce rulings? I would like a good legal explanation on this. I have a friend that is dealing with having to file divorce. It seems that there were issues in the marriage that couldn't be resolved among husband and wife, therefore she turned to a friend for solace and advice. Her husband is accusing her of emotionally cheating and being a "whore" and threatening to take her for all she's worth in a divorce. If all she did was confide in a friend, is that considered cheating and "whoring" around? Does he have any legal grounds against her? Can a case filed under section 13B for divorce under grounds of cruelty be converted to mutual consent? My sister got married in October 2006. Both the parties are Hindus and it was an arranged marriage. Her husband and in-laws harassed her for dowry and since she was unable to get the same they indirectly forced her to leave the house. due to this physical and abusive harassment and as she sensed threat to her life she moved back to her parents house for few days for mental peace in the month of december 2007. she repeatedly tried counseling her husband after this so that they could live peacefully but all in vain. He for no reason sent notice through an advocate stating to return to his house. His advocate repeatedly called her parents and tried to convince divorce through mutual consent. Since the matter had taken legal route she decided to take legal help to resolve the same. she filed a police case under 498A for dowry harassment and also filed case in the family court for divorce on grounds of cruelty under section 13B . He states would give divorce if : 1) it is mutual consent 2) if 498A is withdrawn Please let me know. 1) can case filed under grounds of cruelty under 13b be converted to mutual consent? 2) If yes - what is the procedure 3) is withdrawing 498A a must to close the case in family court through mutual consent?
Can I legally ask the ex to get a hotel room for the kids instead of driving at 1130pm through desert w/ boat? I am divorced and the child are 11 & 7. They were to leave the river house hours ago. They left way too late and now they have 3 hours to go through the desert towing the water ski boat. Do I have any legal grounds to not allow this to happen again? Why are the divorce and child custody laws so biased against men? Let me give my scenario and explain why? I've been divorced now for almost six years. My ex-wife committed adultery multiple times during our marriage. One time I had to go to the health department to be tested for an STD. The other time that I know of she slept with a close family member of mine. I married her and she had two children already and we had my only biological child together. We lived together for almost eight years. Now here's the unfair and biased part. Although I had legitimate grounds for divorce she was still entitled to half and child support for my daughter. I consulted three attorneys on this (male and female) and I was informed that if I had behaved in the same manner. She would be entitle to more. Needless to say, my ex-wife go to live in our house rent-free for three years and plus for 18 months I made child support payments for my daughter while I had to live with my mother. I had the child support stopped because I was still was paying the mortgage where my ex and the children resided. After that however, the ex-wife got involved with Child Protective Services because of neglect of my daughter. I also began to pay child support again at this time because the ex-wife and children moved out of the home. CPS placed my daughter with me but they couldn't address the child support situation. They suggested I try for free legal aid, but I didn't meet the income qualifications. To make a long story short, I had to hire an attorney for $5,000 of which I am still paying for today, in order to get custody of my daughter. Had I not had the money, my daughter would still be with her mother or some family member on her side of the family. I had to pay for the divorce and custody out of my pocket. I haven't had a girlfriend or prospect of a long term relationship in six years. This has hurt financially, emotionally, and socially. Men have to pay to exercise our rights. That's inherently unfair. Women scream equality but in these matters it's just lip service.
Is “Living in Sin” grounds to take full custody of children? My long term BF and I live together, and have plans to get married next summer. He shares 50/50 custody of a wonderful 10 year old daughter with his ex wife. My BFs ex wife, is very bitter (not sure why since she left the marriage for another person) and is threatening to sue for full custody because we are “living in sin.” She has already talked to the daughter telling her that “daddy is a bad man and is going to go to hell because he is living in sin.” This from a woman who committed adultery and divorced TWICE! My wife is a very nice person we've been married for 2 years (not long) & dated for about 1 1/2 years prior to getting married, we lived together 12 years ago for about 1 year. We split up in 99' & found one another 8 yrs later. Married & divorced while we were apart (I have 2 boys with my ex ages 8 & 6, & now we live with my stepdaughter 5 & my daughter 9 mo.) My wife is amicable with her ex, my ex is satan!!! Ongoing legal issues with my ex that I feel have put a strain on our marriage along with financial strains, it just seems that we argue daily, she wants no part of family counseling, she gets extremely angered over things that don't warrant that sort of behavior. Has told me countless times to leave her house in midst of a simple disagreement, has spit in my face over me saying that I sense a little favortism between siblings, lately its been 90% arguing 10% nice nice. We've been intimate maybe once in the last two months, everything is my fault, not hers & I can't seem to get a word in when I want to talk to her. She spend $6000 on cosmetic surgery when we r in a $100,000 credit card hole $80 her $20 me. I pay out 28% child support with additional $600/ mo daycare to my ex & I try to do the best I can but it just feels so ugly being in this. Don't get me wrong, I love my wife but her short wick & constant ugliness makes me want to be alone. & I married her thinking she was my soul mate. I don't know if I'm wasting my time. I only did this because all along I used to say I should have never broke it off in 99, she is the only one I would ever attempt this with again. I guess a decade of being with a cop changed her a bit. I have to draw the line somewhere.
Hi, my dad was married to his ex for 10 years. when they divorced she really put it to him, because he was not? in a position to get a good lawyer at the time of their divorce. He just wanted to get away from her, they hated each other at the end. They have been divorced for 3 three now. Recently, he found out that she had never been divorced from her, what my dad thought was her ex husband, at the time of their marriage. My question is, is there any legal grounds he can go back on because their marriage was not legal due to her not having been divorced. And try to seek a better settlement?
I need a legal separation agreement for up to one year before I can be granted a divorce, according to NY law.? I started completing a divorce packet, however, the grounds for my divorce are not listed. After researching, I became aware that I must submit a separation agreement before I proceed with the divorce. Can I take divorce on the grounds that my husband has schizophrenia ? Please refer to the same question I asked before. Our marriage was typical hindu marriage infront of the society. But it is surely not registered with the marriage registrar.. again my MIL says she did mention about my hubby's schizphrenia, piles and tonsilitis operation to my father when he first visited them. Legal advise on divorce on cruelty grounds? 1. i filed divorce petition on July 15th 2007 & she filed petition on June 26th 2007 2.We filed mutual on october 2007 assuming that it will get resolved soon 2. Got divorce on section 13 on cruelty grounds on her application by making expartie status after mutual discussion with both lawyers. However, in the judgement it is clearly mentioned that " No maintennace cost will arise due to this". no cliams . but only thing is "cruetly word" is irritating me. Should i continue this case till i get in favour of me or withdraw it? if i continue it, who knows when it will complete? even if i continue, will there be any consequences ? Can u advise me whether i can continue this case or withdraw it? if i continue, i have to wait indefinitely.
Do I have any legal grounds? My ex-husband's divorce with his last wife isn't even final yet, and now he's moving another woman and her three kids into his home (her divorce isn't final yet, either). He has primary residence of our 13 year-old son. Suddenly, our son is flunking 2 classes and has an "I don't care" attitude about everything, especially school. He has told me that he does not like the relationship his Dad is in with this woman, nor does he want the woman and her three daughters to move in, yet that's exactly what's happening. I can clearly understand why divorces are allowed on purely secular, legal grounds, but how are so many divorces rationalized from a religious perspective? After all, according to evangelical Christians, abortions are never justified (even in cases of rape or incest), so why does a gray area exist on the topic of divorce?

I have been married now 20 months, i recently found out my husband has been having a affair for 4 months now, and when i confronted him on it he turned into a person i no longer no. We did attend a counseling session were he blamed everything on me & after that the situation became worse, he ended up getting violent in front of my kids from a previous marriage, nut my children are very attached to him being there dad died a 9 yrs ago, and they have known my current husband which they do call dad now going on 5 years, but he has now left the home wants to turn off all power, gas, water, take my car cause everything is in his name, I also work and helped him get to were he is now he has cut all contact with us, so im wondering now if i can get spousal support, and to get him to pay for my legal fees? I did try the nice approach, but he continues to play kid games & i cant afford this big house on my own that we had Just signed for another yrs lease. its 2 months now ive been trying cause I don't want to Just pick my kids up and have to have them start all over in a school, friends and so on. Why is being legally separated a better idea than divorce? People chose to be legally separated. With such a big thing to do, why not get divorced? If its that bad (besides expense, maybe). Have you known any one that hasn't gone thru a divorce? Well, the court system no longer advise marriage counseling's, instead, they promote and allows false accusations for better grounds for divorce. A good example is the famous "domestic violence" charge. The word "violence" is vastly define as simply raising an eyebrow. That can mean hostility. No one can intimidate another during marriages. Don't be surprise that marriages ended up in court everyday with any silly incident but are magnified and exagerated 50% of the time.

Divorce questions,PLEASE help? I am thinking to divorce my husband of 20 years. We have 2 kids but he is becoming unbearable and we fight all the time. I worry for the pain I will cause to my kids and the legal process is something I am not looking forward either. I am trying to find some information first on line or any support groups that can help me. My husband is verbally and sometimes physically abusive to me, I dont want to bring this up as grounds for divorce because he can lose his job and will make matters worse. NY State Divorce Question? My husband of 22 years cheated on me & our two kids, he fell in love with the younger woman, and to top it, they now have a 4 month old baby. I allowed him back home to try and make our marriage work, after 4 mo he claims he just don't love me enough......he loves me as a person........but at the same time claims to love two women at once. I supported him during his 4 months at home by giving him the space to visit his baby at the lover's house. He swore the visits were just for the baby, not the girl. Dear Indian Advocate Fraternity , I have 1 query - Wife has deserted husband after 2 months of their marriage, saying she was forced for the marriage against her will. the marriage is not consummated, (the same being admitted by the husband and the wife in the legal notices sent to each other) also, marriage has not completed 1 year. accordingly, husband filed for nullity petition on a particular date, wife came to know about this thru some sources, hence, exactly after 24 hours,i.e. on the next day, wife, from her parents' place has filed for divorce on grounds of section 13(A) of HMA. wife in her advocate's notice to her husband has admitted that the marriage is not consummated. In such a case can the husband get her divorce petition dismissed under Order 7 Rule 11 of Promissory estoppel which says once you admitted you cant go back on your words by showing the said legal notice to the judge of the family court during the hearing , Is such Order 7 Rule 11 of Promissory Estoppel acceptable in Indian courts.....? ...can wife's petition be termed as infructuous or can it be dismissed on the grounds of maintainability...since both husband & wife agreeing for non-consummation of marriage expecting replies from advocates practising in the Indian family courts for Hindu Marriages awaiting kiran
Divorce issue....? I have been seperated for 2 years. I am seeking a divorce on the grounds of abuse. I am going through legal aid in Texas. My Ex husband has had no contact with myself or children per advise of legal aid. I recently found out I am pregnant by my fiancee and somhow my Ex found out and it threatening to use it against me in the divorce.(he sends Emails, I do not respond) I have filed for child support and custody of my children. But I do not feel safe allowing contact with him as he has threatened to kill me and my fiance and to take the children and disapear. There are some issues with his treatment of the children as well. Do I have alegal leg to stand on? Do I have to wait until my baby is born? (My fiancee and I want to get married before then) Thank you for any and all help. Legal and color vision question? Amanda and Phil both have normal color vision, but Amanda's father was colorblind. Carissa, their first child, was two when they discovered she was colorblind.
